Notice to Vacate - Melbourne CBD Apartment

My real estate agent emailed me on Friday 18th of October with a notice to vacate my apartment by Sunday 20th of October 2024. I don’t really check my personal emails too often so I only noticed it on Saturday afternoon, I am pretty much packed and just need to organise movers for tomorrow.. Also the agent didn’t even feel the need to call me for such a time sensitive topic?

However, I feel like it’s slightly unfair and I have a few issues with the way they are appraoching this. A little back story.

There was major water damage in the whole apartment building back in May 2023. There was a pipe that burst and damaged many apartments in the building. They only just evaluated the property a couple of months ago meaning no works or checks were done ever since the incident.

They are saying “The minimum number of days’ notice required under the Act is 0. I request that you vacate on or before the following termination date: 20 October 2024”

This is their reasoning,

I am giving you this notice for the following reason: Section 91ZL Unsafe premises The premises are unfit for human habitation or have been destroyed totally, or to such an extent as to be rendered unsafe. There is a high level of water damage due to the water event in May 2023. The apartment is deemed uninhabitable during works and therefore the tenant will need to be vacated and the apartment be emptied of any and all contents and furniture.

They have added “You will need to arrange for your belongings to be removed or relocated from areas that will require work.” I’ve looked at their Scope of Works and it’s pretty much the whole apartment.. The exclusions section clearly states “Accomodation costs if you are unable to remain at your premises due to delays and the nature of these works”

I have been living here ever since the incident under the “unsafe” conditions. They haven’t really explained how it’s so unsafe? Am I in danger? Are they not allowed to specify? I don’t understand how it’s so urgent I need to be kicked out with only a few days notice, surely you could give me some more time to organise what to do.

Other things to note: I am on a month to month contract. I just paid by rent for the moth and there’s really no mention if I’m getting paid back? or what’s happening with my bond?

I’m not sure where to start and how to approach my agent with this. I’ve tried calling but it’s the weekend.
